These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the https://www.atelierkintsugi.co website (the "Service") operated by ATELIER KINTSUGI PTE. LTD. ("us", "we", or "our").

Please read these Terms and Conditions carefully before using the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your contact information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

Purchases and bookings are processed via third-party platforms such as PushPress and Stripe. By completing a Purchase, you agree to also be bound by the respective terms and conditions of those services.

By submitting your payment information, you grant us the right to provide the information to these third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, errors in your order, or suspected fraud or unauthorised or illegal transactions.

Availability, Errors and Inaccuracies

We are constantly updating our offerings of products and services on the Service. The products or services available may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service or in our marketing.

We do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, or services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Contests, Sweepstakes and Promotions

ACCOUNTS

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.

You are responsible for safeguarding your password and for any activities or actions under your password. You agree not to disclose your password to any third party and to notify us immediately of any breach of security or unauthorized use of your account.

INTELLECTUAL PROPERTY

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of ATELIER KINTSUGI PTE. LTD. and its licensors. The Service is protected by copyright, trademark, and other laws of Singapore and foreign jurisdictions. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

THIRD-PARTY LINKS

Our Service may contain links to third-party websites or services that are not owned or controlled by ATELIER KINTSUGI PTE. LTD..

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused or alleged to be caused by use of or reliance on any such content, goods or services available on or through any third-party websites or services.

We strongly recommend you review the terms and privacy policies of any third-party services you visit or use.

USE OF PHYSICAL PREMISES

You acknowledge that physical activity and use of our facilities—including, but not limited to, gym training, infrared sauna, or other services—carry inherent risks of injury or harm.

By using our services at WeWork, 21 Collyer Quay, Level 3, Singapore, you agree to do so voluntarily and assume all responsibility for any risk, illness, injury, loss, or damage, including those arising from the actions of other clients, staff, or third parties.

You will comply with Kintsugi’s House Rules and WeWork Membership House Rules (link) and any other regulations imposed by WeWork or the building landlord while on the premises.

INDEMNITY

You agree to indemnify, defend, and hold harmless ATELIER KINTSUGI PTE. LTD., its directors, staff, affiliates, service providers (including PushPress and Stripe), and WeWork Singapore Pte Ltd, from any claims, demands, damages, costs, or liabilities arising from:

  • Your use of the Service or our physical space

  • Your breach of these Terms

  • Any personal injury, property damage, or loss caused by your actions or negligence on the premises

This clause survives termination of your use of the Service or facility.

TERMINATION

We may terminate or suspend your account or access to our Service immediately, without prior notice or liability, for any reason including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by discontinuing use of the Service.

LIMITATION OF LIABILITY

In no event shall ATELIER KINTSUGI PTE. LTD., nor its directors, employees, partners, agents, suppliers, affiliates, or WeWork Singapore Pte Ltd, be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

(i) your access to or use of or inability to access or use the Service;
(ii) any conduct or content of any third party;
(iii) any content obtained from the Service; and
(iv) unauthorized access, use, or alteration of your transmissions or content.

DISCLAIMER

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

  • the Service will be uninterrupted or error-free;

  • defects will be corrected;

  • the Service is free of viruses or harmful components;

  • the results of using the Service will meet your expectations.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Our failure to enforce any provision of these Terms will not be considered a waiver of any rights. If any provision is held to be invalid or unenforceable, the remaining provisions will remain in effect.

These Terms constitute the entire agreement between us regarding the Service and supersede any prior agreements.

UPDATE TO TERMS

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to new terms taking effect. What constitutes a material change is at our sole discretion.

By continuing to access or use our Service after revisions take effect, you agree to be bound by the updated terms. If you do not agree to the new terms, you must stop using the Service.
